A 12 year olds intelligence....

Post by Bryce Silver-Wind » Mon Oct 15, 2018 7:41 pm

Since the Admin has seen fit to directly insult me, rather then consider what I am saying as a fact, and I cannot respond to the insult either to clarify how he is wrong other then a private message...Here is the post I am replying to:

This sounds like something a twelve year old would come up with. I mean, really? You think that breaching Discord's terms of services is ILLEGAL? What if I added a little document that you had to agree to before connecting to Arelith which made you forfeit your freedom and income if you accepted? Do you think that it would be illegal for you to refuse to hand over your monthly salary and get in the coal mines when we demanded it? sigh

"The term "illegal" is ambiguous. Violating the terms of an agreement between you and a commercial entity may give rise to civil claims against you and, in that sense, the entity could certainly take you "to court". But if by "illegal" you are thinking of criminal charges, I find it hard to imagine many scenarios that would give rise to criminal charges that could be prosecuted against you, it really depends on the nature of the violation.

For example, a website may provide that it is a violation of their Terms and Conditions for you to post any child pornography anywhere on their site. If you were to violate this condition by posting such material, not only could the company take action against you in a civil court, they could (and probably would) refer the matter to law enforcement for criminal prosecution.

On the other hand, if you were to violate a condition against using foul or abusive language while posting to a web site, you could be removed from the site by the hosting company but there would not likely be any criminal liability. We still have freedom of speech in this country and protected speech is not criminally actionable."

So yes, breaching a companies TOS "IS" infact illegal, though weather it is illegal by Civil law, or by Criminal law is the difference in how it is handled, in Civil you could be prone to lawsuits and bans from that companies property, Criminal could have you facing jail time and much more serious consequences. Thought I would at least take a moment to clarify for people confused by this.
