Circle of death, and Scare

Cicle of death has no meaning past lvl 9 enemies... and using a lvl 6 spell to kill lvl 8's is kind of overkill anyways. but removing the lvl 9 cap is too much because it would instantly become a better finger of death or wail of the banshee.

How about..

Description: A wave of negative energy bursts from the target location. A number of enemy creatures equal to 1d4 per caster level must make a fortitude save or die, beginning with those creatures with the lowest hit dice. Creatures with 9 or more hit dice are instead struck by 1d6 negative energy damage per level of the caster up to a maximum value of 15d6, and if they succeed their save, they only take half of that damage.

Also, the lvl 1 scare spell. Daze works with targets with the same amount of hit-dice as you, how about making this one work the same way?
