1. Can I take epic dodge at assassin level 16, or is improved evasion only added after I've selected my feats and skills and clicked "Accept"?
2. If not, is it possible to change this in a future update somehow?

Most likely due to the way mechanics work, you won't be able to take Epic Dodge the same level you get Improved Evasion.

The feats are added by script after the level-up process.
Unfortunately this timing can't be changed until paths and custom content are delivered by means of hak rather than script. The only solution would be to have the feats granted at a lower level, which likely won't be happening in this case.
